Czech Populist Prime Minister-Elect Declines to Sell Business Empire During Conflict-of-Interest Row

Andrej Babiš, the self-styled tycoon who won the recent Czech election, has refused to sell his extensive business interests, while asserting he will address a ethical dilemma that could block him from assuming the position of prime minister.

Stance on Business Holdings

Babiš, whose political movement came first in the October election but lacked a majority in parliament, stated in a online statement that he will not sell his Agrofert conglomerate, which is active in agriculture, food processing, and chemical industries.

“I have consistently said I will never sell Agrofert. I have repeatedly stated I will resolve the conflict of interest in compliance with Czech and EU regulations,” Babiš commented. “This is not like selling a pastry in a bakery.”

Head of State's Demand

The head of state, Petr Pavel, announced that the elderly populist must publicly explain how he will eliminate ethical conflicts stemming from his corporate dealings before being appointed premier.

The Czech constitution “explicitly requires the head of state to consider the potential occurrence of a ethical issue and the possibilities for its resolution” when appointing cabinet members, Pavel's office explained.

The head of state “wants it to be clear in what precise manner Andrej Babiš will meet his statutory duties”, the statement added, stating that Pavel was ready to appoint Babiš as prime minister “immediately” once the issue was resolved.

Business Operations and Regulatory Concerns

Babiš's several hundred firms, primarily under the Agrofert group, function in the Czech Republic and other central European countries, receiving substantial funds in national and EU farming and other grants, as well as government deals.

Under national legislation, cabinet members are barred from receiving state support or contracts. The anti-corruption organization Transparency International has stated that to prevent a conflict of interest, Babiš must either sell, decline public contracts, or not enter public office.

Past Tenure and Present Plans

Babiš said he would “follow the laws” if selected as prime minister, but declined to detail how in beforehand because the issue was “an extremely sensitive and private affair for me, and the media will invariably criticise me anyway”.

During his first term as prime minister, from 2017 to 2021, Babiš encountered multiple court cases and an European inquiry over possible conflicts of interest. He temporarily moved his assets into fiduciary arrangements, while keeping some influence over them.

A judicial body and the EU executive both ruled that this was insufficient. Babiš stated recently that he was once more the exclusive proprietor of Agrofert and insisted he was “implementing measures” to prevent a conflict of interest, but declined to reveal specifics.

Coalition Deal and International Consequences

The wealthy politician has signed a coalition agreement with two minor right-leaning groups, the ultra-conservative, pro-Russian SPD, which has advocated a public vote on leaving the EU, and the Motorists for Themselves, which has mainly campaigned against the EU’s Green Deal.

The new government, if approved, is likely to bolster the populist bloc in central and eastern Europe and might strain backing from Western nations for Ukraine – even though Babiš has called Ukraine’s president, Volodymyr Zelenskyy, to confirm of Czech support.

Pavel, who as head of state shares responsibility for international relations, also demanded that the coalition’s programme include a statement on the official stance on Russia’s war in Ukraine, with a pledge to fulfilling Nato obligations.

The head of state has earlier stated he would not approve any ministerial nominees who might question the nation's international alliances, a requirement that the ultra-conservative party has said it will satisfy by nominating independent technocrats.
